GENERAL REGULATIONS FOR THE USE OF FACILITIES AND THE RUNWAY
Art.1
The "Riccardo Paletti" racetrack in Varano Melegari (Pr) - Strada per Fosio n.1, is managed by SO.GE.S.A. S.r.l. (Società Gestione Sports Automotociclistici) based in Varano de' Melegari - Strada per Fosio n.1, and is owned by the Municipality of Varano de' Melegari (PR).
The purpose of SO.GE.S.A. S.r.l. is:
- The organization and management of competitions and sports and cultural events in general;
- The management of sports facilities and any other facilities or activities related to or resulting from sports and cultural activities;
- The organization and management of advertising both on its own behalf and on behalf of third parties;
- The purchase, sale or exchange of real estate.
Art.2
These regulations govern entry to the Racetrack and the use of its facilities by third parties.
Every provision (rates, hours, etc.) issued by the Management and displayed on the special notice board at the offices of the Autodrome Management is an integral part of these regulations and violators are liable to penalties, without prejudice to their possible referral to the Judicial authorities and reserved to SO.GE.S.A. S.r.l. any better protection of the law.
Art.3
The entry of the public and users of the runway are subject to compliance with the requirements, procedures and timetables established in an unquestionable manner by the Management or in the case of events, by the particular programs and regulations of the same, and, in addition, to the payment of the relevant fees.
Art.4
Persons and vehicles admitted to the Racetrack area are required to comply with the instructions given by the Racetrack staff, to comply with the rules relating to road traffic (see Highway Code) and to observe the prohibitions in force in the Racetrack area.
Specifically:
- Unaccompanied children under the age of 14 (fourteen) are not allowed;
- access is prohibited to vehicles without the necessary badges issued for this purpose by the management or organizers of any events;
- is equally prohibited from entering particular areas inside (pits, parterre, press area, etc.) of the racetrack for which specific access passes are to be issued to anyone without them;
- It is forbidden to bring in animals of any kind or size;
- it is strictly forbidden to plant and cause to be planted in the asphalt surface of the Paddock nails, pegs, stakes or anything else that may cause the slightest damage to the surface in question;
- it is strictly forbidden to abandon and have abandoned hazardous waste (batteries, tires, electrical equipment, mechanical parts, etc.) in any area of the Racetrack including the appropriate municipal waste receptacles (bins). Environmental provisions under Leg. n° 22/97.
- Violators will be immediately removed from the Autodrome area and subjected to the resulting damages as per law.
Art.5
The racetrack and facilities of the Autodrome may be granted for use for the holding of events of various kinds (sports, technical, entertainment, etc.) or for sports, technical or other tests.
The granting of the facility may be denied by Management, at its sole discretion and without the obligation to provide specific justification.
Art.6
The use of the track and facilities may take place on an exclusive or non-exclusive basis as specified below:
the exclusive use of the track may vary in duration and may be granted with or without various services within the Racetrack, applying the relevant rates displayed at the Management. Exclusivity is awarded upon request or at the judgment of the management according to the type of vehicles and track use.
In the case of auto-motorcycling events or record attempts, exclusivity is mandatory by requesting the relevant fees from SO.GE.S.A. S.r.l.
For rehearsals, events and other uses, all the rules of these regulations apply.
In addition, the commitment of the runway may be obtained upon payment to SO.GE.S.A. S.r.l., within the term set by it, of a down payment equal to 30% of the total amount of the rental and services established for the duration of employment. Non-use by the user shall not entitle the user to the return of the same deposit unless at least 10 (ten) days' notice for events and 48 (forty-eight) hours' notice for other uses.
In the event of partial use by the user, SO.GE.S.A. S.r.l. is entitled to the amount for rental and services provided to the extent corresponding to the actual duration of use, with a minimum deductible of 50% of the amount of the total cost.
Failure to use or partial use due to force majeure causes independent of the user's fact or will, recognized as such by SO.GE.S.A. S.r.l., the amount corresponding to the duration of actual use will be due, without prejudice to the reimbursement of expenses incurred by SO.GE.S.A. S.r.l.
Any compensation in favor of the user in the above cases is excluded.
in the case of non-exclusive use of the track, vehicles of one or more users are allowed with limitations regarding the number, type and categories of vehicles at the sole discretion of the Management, the rules of the International Sporting Code (FIA) being in force; may, also take place tests and tourist traffic according to the rules of the Highway Code.
The use of the track is in all cases subject to advance payment of the rental fee according to the fee schedule displayed at the Management offices.
Art.7
General rules for the use of the track and facilities:
- The entry of any vehicle onto the track is subject to the driver's signature of a release of liability to SO.GE.S.A. S.r.l., the deposit of an identity document, and may take place only after receiving a track entry permit from the person in charge.
- Only drivers, mechanics and those expressly authorized by management are allowed to enter the pits.
- Entry and/or parking, even with mobile structures, in the paddock area is subject to the signing of the specific form inherent in the assumption of responsibility for any damage caused on site (e.g., planting pegs, nails and stakes or anything else that may cause damage to the asphalt surface), for the abandonment of hazardous waste, for the deadline by which to clear the paddock area of things and people.
- Motorcycle drivers are required to enter the track equipped with a protective helmet, suit, gloves and suitable boots.
- Automobile drivers and any passengers are required to enter the track with protective helmets and seat belts fastened.
- For racing cars and motorcycles, the requirements of the respective national sports regulations in force regarding clothing and seat belts apply.
- The number of vehicles allowed to circulate at the same time on the track will be determined from time to time by the management and can never exceed the maximum number granted in CSAI, FIA and FMI homologations.
- A maximum number of persons is allowed on each competition car equal to the number of front seats; on motorcycles, only the driver is allowed. In the case of type-approved vehicles, the maximum number of seats is that shown in the registration certificate; in other cases it is determined by the Management. Motorcycle drivers must be at least 18 years of age.
- Each driver is expected to observe proper, fair and responsible behavior toward other drivers and attendant personnel on the track.
- Each driver is required to verify that the vehicle he/she intends to use is perfectly suitable for the test to be carried out, assuming in this regard all responsibility for any accidents and consequent damage to his/her own person or property or to third parties and third parties' property, including drivers and any persons transported, companions, mechanics, etc., as well as to the Autodrome facilities, relieving SO.GE.S.A. S.r.l. and the staff in charge of the same from any encumbrance.
- Reversing or turning in the opposite direction to the intended direction (counterclockwise) is strictly prohibited.
- It is forbidden to stop on the runway, and in the event of a forced stop the vehicle must be pushed onto the side strips or to the side of the runway and out of the way of any other users.
- It is forbidden to refuel or make repairs within the circuit and it is, equally, strictly forbidden to cross the track either on foot or by vehicle (including for companions, mechanics, photographers, etc.) except at permitted and specially regulated times.
- Racing and betting among track users are prohibited.
- If a driver notices an accident of any nature, he/she is required to immediately notify the pits and the appropriate personnel. Drivers are required to return to the pits at a reduced speed, signaling entry to drivers following them.
- The track manager may, failing the conditions of regularity and safety, suspend the practice round.
- The track manager may, in his or her sole discretion, refuse entry to the track or order the immediate return to the pits to any driver who may create a disturbance or danger to himself or herself or other track users.
- It is strictly forbidden to test cars and/or motorcycles in the paddock area.
Art.8
SO.GE.S.A. S.r.l. reserves the right to perform directly or indirectly through its appointees or technical pater, as well as to use photographs, video, film, web, both overall and detailed shots of the Event/Event, side events, pits, paddock, grandstands, parking lots, etc, without the Organizer/Participant being entitled to claim any compensation, holding, moreover, SO.GE.S.A. S.r.l. harmless from similar claims that may be received from third parties connected to the same Organizer/Participant in any capacity.
SO.GE.S.A. S.r.l. may, in addition, authorize one or more television, radio or whatever broadcasters to film and/or record and/or photograph for use in their programming and activities, without an additional release.
SO.GE.S.A. S.r.l., for its part, undertakes not to market such material, but to use it for promotional and informational purposes only. Signing below constitutes, to all intents and purposes and with all knowledge of the case and of the law, a disclaimer to the extent specified above.
Art.9
SO.GE.S.A. S.r.l. does not guarantee, unless previously requested, during the trials the presence of medical assistance, fire-fighting, flag signaling services (if the latter are present they have the following meanings: Yellow flag: slow down, danger - Red flag: immediate and absolute stop of all drivers - Checkered flag: stop for end of practice session).
Art.10
The runway is not completely fenced off, so crossings of the runway by animals or unauthorized persons cannot be absolutely ruled out, and in addition, the maintenance of the runway may be temporarily deficient, so unconnected embankments, guardrails not fully installed in a workmanlike manner, and pavement not in perfect condition cannot be ruled out. As a result of this, it is the duty of each driver to personally ascertain the condition of the track itself.
Art.11
Violation, even partial, of the above may, if necessary, result in the immediate removal of the offenders from the "R. Paletti" facility, without prejudice to the possibility by SO.GE.S.A. S.r.l. of any further legal action against them.
Art.12
SO.GE.S.A. S.r.l. reserves the right to take and use, directly or indirectly through appointees, photographs, video, film, web, both overall and detailed footage of events, side events, the pits, paddock, grandstands, parking lots, vehicles or people, without any person being entitled to claim compensation or indemnity.
SO.GE.S.A. S.r.l. may also authorize television, web or whatever companies to film and/or photograph for use in their programming and activities, without additional release. SO.GE.S.A. S.r.l., to the extent of its competence, undertakes not to commercialize such material, but to use it for promotional and informational purposes only.
Art.13
SO.GE.S.A. S.r.l. is not responsible for theft of and/or damage to property (including vehicles of any kind) left in storage throughout the Autodrome area and, acknowledging that parking lots, boxes, etc. located within the Autodrome are unattended, each user acknowledges his or her full and exclusive responsibility for the safekeeping and surveillance of things brought into the Autodrome.
Art.14
The Board of Directors of SO.GE.S.A. S.r.l. reserves the right to update these regulations, as well as to make changes to them without prior notice. The display of the regulations at the Racetrack Management gives immediate effect to what is stated therein. Varano de’ Melegari (PR), 1 Gennaio 2022
